These Terms of Service (“Terms”) govern your use of LLXCO.com (“Site”) and purchases from LLXCO, doing business as LLXCO (“LLXCO,” “we,” “us,” or “our”).

By accessing the Site, creating an account, or placing an order, you agree to these Terms.

Nothing in these Terms is intended to waive or limit any consumer right that cannot lawfully be waived or limited.

1. LLXCO

LLXCO is an artist-led fashion and lifestyle brand offering apparel, accessories, artwork-related merchandise, and other products.

Certain products are manufactured, printed, or fulfilled on demand through third-party production and fulfillment partners.

2. ELIGIBILITY

By using the Site, you represent that you have legal capacity to enter into this agreement or are using the Site with authorization of a parent or legal guardian where required.

You may not use LLXCO.com for an unlawful or unauthorized purpose.

3. ACCOUNTS

You agree to provide accurate and current information when creating or using an account.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account to the extent permitted by applicable law.

We may suspend or terminate accounts reasonably believed to be involved in fraud, abuse, unlawful conduct, security threats, or violations of these Terms.

4. PRODUCTS

We make reasonable efforts to accurately describe and display our products.

However, product colors and other visual characteristics may appear differently depending on your screen, device, display settings, and lighting.

Because some LLXCO products are individually manufactured or printed on demand, minor variations in print placement, color, texture, dimensions, or appearance may occur.

Product availability may change without notice.

5. SIZING

Sizing charts may be provided for applicable apparel and other products.

Customers should review the applicable sizing information before purchasing.

Sizing may vary among garments, manufacturers, product types, and styles.

6. PRICES

Prices are displayed in the currency shown on the Site and may change without notice before an order is placed.

Taxes, shipping charges, duties, and other applicable charges may be added as appropriate.

A price change will not retroactively alter the agreed price of an order already accepted except where permitted by applicable law, such as to correct an obvious error.

7. PAYMENT

Payments are processed through Shopify and applicable payment providers.

By submitting a payment method, you represent that you are authorized to use it and authorize the applicable transaction.

8. ORDER ACCEPTANCE

Submitting an order does not necessarily constitute final acceptance of the order.

We may refuse or cancel an order where reasonably necessary because of:

• product unavailability;

• obvious pricing or listing errors;

• payment failure;

• suspected fraud;

• shipping restrictions;

• violation of these Terms; or

• circumstances outside our reasonable control.

If we cancel an order after collecting payment, we will issue any refund required by applicable law.

9. PRINT-ON-DEMAND PRODUCTS

Certain LLXCO products are manufactured or printed specifically after an order is placed.

Production, fulfillment, and shipping may be performed by authorized service provider.

Production and delivery dates are estimates unless expressly represented as guaranteed.

10. RETURNS, EXCHANGES, AND REFUNDS

Because many LLXCO products are produced on demand, all sales are final except for defective, damaged, materially incorrect products or where applicable law provides a non-waivable right of return, cancellation, refund, replacement, or other remedy.

We generally do not accept returns or exchanges because a customer:

• selected an incorrect size;

• changed their mind;

• prefers another color or style;

• no longer wants the item; or

• provided incorrect order information.

Customers should carefully review product descriptions, sizing information, shipping information, and their order before completing checkout.

If a product arrives damaged, defective, or materially different from the product ordered, contact [ladylibertyandco@gmail.com] within [14] days after delivery and provide your order number and reasonable evidence of the issue, such as photographs.

Nothing in this return policy overrides any mandatory consumer right available under applicable law.

Where a jurisdiction provides a mandatory cancellation, withdrawal, conformity, refund, replacement, or other consumer right that cannot lawfully be waived, that right will apply notwithstanding this policy.

11. SHIPPING

LLXCO ships within the United States and to select international destinations.

Shipping availability, pricing, and estimated delivery times depend on the destination, product, fulfillment location, and shipping method.

Delivery estimates are not guarantees unless expressly stated otherwise.

12. INTERNATIONAL ORDERS, TAXES, AND CUSTOMS

International orders may be subject to customs duties, VAT, import taxes, brokerage charges, or other fees imposed by the destination jurisdiction.

Unless expressly stated otherwise during checkout, these charges are not included in the product price or shipping charge and are the customer's responsibility.

International customers are responsible for ensuring that products ordered may lawfully be imported into their destination.

Customs processing and other circumstances outside our reasonable control may delay delivery.

13. SHIPPING INFORMATION

Customers are responsible for providing accurate and complete shipping information.

If you discover an error in your shipping information, contact us as soon as possible. We cannot guarantee that an address can be changed after production or fulfillment begins.

Rights and responsibilities relating to lost, delayed, or misdelivered shipments will be determined according to applicable law and the circumstances of the shipment.

14. INTELLECTUAL PROPERTY

Unless otherwise stated, original material appearing on LLXCO.com—including LLXCO artwork, illustrations, graphics, photographs, text, logos, branding, product designs, and other original creative material—is owned by or licensed to LLXCO and is protected by applicable intellectual-property law.

Purchasing an LLXCO product does not transfer copyright, trademark, or other intellectual-property ownership.

Except where legally permitted, you may not reproduce, manufacture from, distribute, sell copies of, commercially exploit, or create unauthorized derivative products from LLXCO's protected material without authorization.

15. TRADEMARKS AND THIRD-PARTY MARKS

LLXCO names, logos, slogans, collection names, and other brand identifiers may be trademarks or otherwise protected.

Third-party trademarks appearing in connection with blank products, manufacturers, fulfillment providers, payment services, or other third-party products remain the property of their respective owners.

Their appearance does not transfer ownership to LLXCO.

16. PROHIBITED USES

You may not:

• use the Site unlawfully;

• commit or facilitate fraud;

• interfere with Site security;

• introduce malware or malicious code;

• attempt unauthorized access to accounts or systems;

• impersonate another person;

• infringe intellectual-property or privacy rights;

• scrape or harvest information through unauthorized automated means; or

• use LLXCO intellectual property for unauthorized commercial purposes.

17. THIRD-PARTY SERVICES

LLXCO uses third parties, including Shopify and third-party manufacturing, print-on-demand, and fulfillment service providers, to provide portions of our services.

Third-party websites and independent services may have their own terms and privacy practices.

To the extent permitted by applicable law, LLXCO is not responsible for independent third-party services outside our reasonable control.

18. SITE AVAILABILITY

We do not guarantee that LLXCO.com will be continuously available, uninterrupted, or error-free.

We may reasonably modify, maintain, suspend, or discontinue Site functionality.

19. DISCLAIMERS

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

WE DISCLAIM WARRANTIES THAT MAY LAWFULLY BE DISCLAIMED.

THIS SECTION DOES NOT EXCLUDE OR LIMIT WARRANTIES, STATUTORY GUARANTEES, OR CONSUMER RIGHTS THAT CANNOT LEGALLY BE EXCLUDED OR LIMITED.

20. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LLXCO WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SITE OR PRODUCTS.

WHERE LIABILITY CANNOT LAWFULLY BE EXCLUDED, IT WILL BE LIMITED ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.

Nothing in these Terms excludes liability that applicable law prohibits us from excluding.

21. PRIVACY

Our collection and processing of personal information is described in our Privacy Policy and Cookie Policy.

Where applicable, privacy choices are also available through LLXCO.com's privacy controls.

22. EMAIL COMMUNICATIONS

Customers may voluntarily subscribe to promotional email communications.

Marketing recipients may unsubscribe through the unsubscribe mechanism contained in applicable emails.

Transactional communications concerning purchases, accounts, security, or customer-service matters may still be sent where necessary.

23. GOVERNING LAW

Except where applicable law requires otherwise, these Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles.

This choice of law does not deprive a consumer of mandatory protections afforded by the laws of the jurisdiction in which that consumer resides where those protections cannot lawfully be waived by contract.

24. SEVERABILITY

If a provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

25. CHANGES TO THESE TERMS

We may update these Terms periodically.

The current version will be posted on LLXCO.com with the applicable “Last Updated” date.

Where required by applicable law, we will provide additional notice of material changes.
